JM: Tell us about the pre-sentencing process: Milles: after i was charged i was taken to the intake part
of the jail. it was here that i was booked (info
taken property logged)and was held until my
arraignment. at my arraignment, i was taken to a
room where there was a closed circuit tv. i was
told not to talk just to listen. i felt very
helpless because i could not talk or say my side
of things. i just had to sit and take whatever the
judge had to say.
JM: Did you have police stop by your house for questioning? If not please give us details on how you came to be arrested. Milles: yes, the police did come. they came initially to
speak with me and ask me questions. they left
after the first set of questions. they returned
later with a warrant for my arrest where they
proceeded to read me my rights and arrest me.
there were two police cars and three police men. i
thought that was a bit overkill.
JM: What as court like? Please give as many details as you recall. Milles: my court appearance was very nerve racking. i was
very nervous and a bit embarrassed. i walked into
the court and there was a whole bunch of people
waiting for their turn to make their plea. i had a
very short meeting with my lawyer. when court
began session i sat and waited to hear my name
called. when i was called i stood up walked to the
front. the judge read what i was charged with and
asked the da for what information they had on the
case. then the judge looked to me to state my
plea. i had plead guilty, so the judge decided to
accept my plea and found me guilty . from here i
was taken to a holding cell in the courthouse and
told to wait for transport to the jail.
If someone turns themselves in regarding a warrant, lets say for a class A misdemeanor, for over 18 years ago... still following them around. Any thoughts on how that might go as far as pre-sentencing, and arraignment. No other history, and has medical condition. This is going on with a friend, just trying to figure out how long they might be held. Thanks for your help.
